Abstract

Objective. To analyze changes generated by Law 1448 of 2011 known as the “ Victims’ and land restitution Bill” to certain traditional structures of civil law and probatory evidence of ownership, possession and occupation of the oppositionist in the special restitution process, as well as aspects of social impact that could result from the application of the model of land restitution to the victims of the armed conflict in Colombia. Methodology. This research used the descriptive analytical method based on the overview of the concepts of ownership and possession to analyze it later facing the changes of the new law and the proposed 1448 Bill from 2011. Results and conclusions. The previous in order to establish the implications, consequences, advantages or disadvantages of the implementation of the special procedure for land restitution to the victims of the armed conflict in Colombia.
