Abstract

The class action is one of the main instruments for the protection of the environment in Colombia. Class actions have recognized economic incentive. However, Act 1425 from 2010 repealed two Articles from Law 472 from 1998 which recognized the incentive. But there has not been studied if the reward by virtue of Article 1005 of the Civil Code, is still in force. Using various contradictions solving techniques, a solution is proposed, which is the contribution of this study and which goes beyond jurisprudential rulings that might arise in the future.
