Abstract
The author maintains the thesis that if the legal instruments for international criminal persecution of terrorism are already available, then the lack of results must be due to the fact that many States lack the political will to use them. The contribution of law to the formation of said political will consists in fortifying the institutionality, equipping it with legitimacy in regards to individual guarantees. Any legal development that with intentions of effectiveness sacrifices individual rights will definitely be inoperative, because it will not be in conditions to generate the political acceptability essential for its application.
