Abstract
The economic theory provides insight into the general structure of laws. This article shows how economics can be used to explain the relationship between Law and Economics as theories. Historical and methodological aspects on the emergence of Law and Economics in their positive and normative versions, as well as mentioning the different schools of thought and the critical positions of some scholars of legal studies. It also discusses how the emphasis placed on the positivistic vision of Law allows some approximations by using the neoclassic theory.
