Abstract
Independence and impartiality, the latter being part of neutrality, are duties, more than judges’ rights. Impartiality, from the perspective of three non-skeptic conceptions of law and its application (legal formalism, normative positivism, postpositivism), isn’t a common place, instead it is seen from different perspectives that have tend to confuse it with the concept of neutrality.
