Abstract

This article assumes that the current civilizing crisis affects the environment tremendously, especially with respect to water, and essential element for the survival of the species. It is proposed here to consider drinking water as a “fundamental good”, available to the State and the market, forcing its supply to all by the public authorities. Therefore an alternative from legal theory point of view is presented in order to strengthen the enforceability of the provision of water to all people and, at the same time, to offer a suggestion of possible safeguard for the protection of drinking water sources.
